Hallo!
ich habe einen Einsatzvertrag mit einer Agentur. In dem Vertrag ist eine Vertragsstrafe für eine nicht Durchführung von Einsätzen vorgesehen. Jetzt habe ich einen Ersatzpromoter für die Einsätze besorgt und er bekommt ja ein eigenes Vertrag von der Agentur. Trotzdem schreibt mir die Agentur, dass Sofern diese Freelancerin die Tage wie mit ihr vereinbart durchführt, werden sie mir selbstverständlich keine Vertragsstrafe geltend machen.

Meine Frage ist, warum sollte ich für die von der anderen Promoterin durchgeführten Einsätze haften, wenn sie schon einen eigenen Vertrag mit der Agentur hat?
